What a counterfeit is

A counterfeit is a product sold under a trademark the seller has no right to use. The mark matches a registered brand, or comes close enough to confuse a buyer. Counterfeit is a legal term. It says nothing about build quality. A $40 fake and a $900 fake are both counterfeit when the mark is used without permission.

The term matters in three places: criminal law, customs seizure, and civil suits by the brand owner. Each has its own test.

Counterfeit, replica, knockoff

  • Counterfeit: carries the brand mark on goods the brand did not make.
  • Replica: a copy. If it carries the mark, the law treats it as counterfeit.
  • Knockoff: copies a design without copying the mark. Design claims can apply in some cases. Trademark law does not.

Sellers use the words replica and inspired to avoid the word counterfeit. The label does not change the analysis. The mark on the goods does.

US law

18 U.S.C. Section 2320 covers trafficking in counterfeit goods. A first offense carries up to 10 years in prison and a $2,000,000 fine for an individual, or $5,000,000 for a corporation. A second offense raises the terms to 20 years, $5,000,000, and $15,000,000.

The Lanham Act, 15 U.S.C. Section 1114, gives the mark owner a civil claim. Under 15 U.S.C. Section 1117(c), a court can award statutory damages of up to $200,000 per mark per type of goods, and up to $2,000,000 when the use is willful.

19 U.S.C. Section 1526 bars import of goods that copy a US mark recorded with Customs. CBP can seize the shipment. A buyer who imports a counterfeit watch can lose the item and the money.

Federal law does not target the person who buys a counterfeit for private use. It targets sale, trafficking, and import. State law and civil suits can reach past that line.

Seizure data

CBP and Homeland Security Investigations seized 19,724 shipments of counterfeit goods in fiscal year 2023. The goods would have been worth about $2.7 billion at retail if genuine. Watches and jewelry ranked near the top of seized categories by value.

OECD and EUIPO put counterfeit and pirated trade at $464 billion in 2019, or 2.5% of world trade.

Checks on a watch

  1. Price against the brand retail list. A new watch at a fraction of list price needs a paper trail.
  2. Serial number. Ask the brand service center to confirm it.
  3. Dial print. Compare letter spacing and font to a factory photo. Counterfeit dials show gaps and thick strokes.
  4. Caseback engraving. Depth and edge sharpness differ from laser etching on genuine cases.
  5. Movement. An exhibition back shows finishing, jewel settings, and engraving. Cheap copies show stamped plates.
  6. Seller details. Get a business address, a return window in writing, and a payment method with a dispute process.

Costs of a counterfeit watch

No brand service center will touch the watch. Parts do not match. Water resistance claims are untested. Resale value is near zero. A seized parcel adds the loss of the full purchase price.
